Avoiding Dog Bites During Seasonal Gatherings

Thanksgiving is nearly here and Christmas is coming right afterwards! However, this time of year may not be easy for your pets.  The holidays can be a stressful time for both dogs and their owners.  Anecdotally, reports of dog bites appear to increase during the holiday season and is often appears to be due, in part, to dogs being exposed to an increase in movement, activity, and exposure to unfamiliar people.  These unknown people and situations can be frightening to dogs, and may make them appear defensive and more prone to biting people. Electric Scooters Misuse and Danger Results in Class-Action Lawsuit

Think carefully before renting an electric scooter! Many vacation and travel destinations have begun using electric scooters as a new, interesting way to show visitors around a new city.  However, these scooters pose a large potential safety risk.  In fact, a class-action lawsuit was recently filed against a leading national electric scooter company.  The lawsuit states that these scooter companies are not taking appropriate care to make sure their riders, and nearby pedestrians, are safe while these vehicles are in use.  The lawsuit further claims that some of these scooters are made with defective, and potentially dangerous, parts.  One personal injury lawyer cited within the news article below stated that she's received in excess of 100 calls relating to scooter injuries.  Many of these injuries are consistent in type, and involve broken body parts and head injuries.  Many of these injuries have required surgeries.  

PA Tractor-Trailer Crash Results in Several Deaths

We hope cases like these never occur, but unfortunately we do not live in a perfect world.  Just this week, a tractor-trailer driver is under fire for being involved in an accident that resulted in the deaths of several people, including a toddler, in Pennsylvania.  

Retail Stores and Slipping on Floors

Do you sometimes enter a retail store or other public establishment and think "Huh, well THAT sidewalk/ramp/curb/entrance/puddle doesn't look safe". Chances are, you are probably right.  Sometimes, these unsafe walking conditions lead to accidents, which then makes those businesses potentially liable for slip-and-fall lawsuits.  One such accident occurred recently at a Big Lots in San Diego, CA.  A woman fell in a Big Lots after she slipped and fell on a patch of dirt of the floor, which caused her to fall into a soda display shelf.  As a result, she developed shoulder and neck injuries, had multiple surgeries, and required physical therapy afterwards.  The injured party's attorney reported that Big Lots doesn't have a set sweeping schedule, and instructs employees to sweep "as needed". They implied that this lack of cleaning schedule may have, in part, contributed to the conditions responsible for this accident.  The results of this trial have not been released yet, but it will be interesting to see what happens. 

Instagram and your Lawsuit

As always, it is important to be careful what you post on your social media account.  This is even more important when you are involved in a lawsuit.  One New York based lawsuit is currently making news in the legal world for a social media matter regarding to a car accident.  According to the background of the claim, a woman alleged that she suffered injuries from a car accident that caused her a significant loss of enjoyment of life.  However, her Instagram was reviewed during the legal proceedings, and included post-accident pictures of the woman participating in strenuous outdoor activities and enjoying a vacation. It may be likely that these pictures may have a negative impact towards the woman's claim.  

What Is A Bad Faith Claim?

Have you ever heard the term "bad faith claim" and weren't quite sure what it meant?  In short, this concept describes situations where insurance companies don't fulfill their policy obligation to you to its full ability.  This can mean that they aren't timely in processing your claim, aren't fully investigating the claim, or aren't paying you properly for your claim.  Each state is slightly different in how it identifies, processes, and frames bad faith claims.

State Guardrails and Your Car Accident

In recent news, the Pennsylvania Supreme Court ruled that PennDOT, our state's transportation department, can be held liable for vehicular injuries caused by dangerous guardrails on our state's highways.  Usually, the state cannot be sued for damages due to negligence under an act called the Sovereign Immunity Act; however, it was ruled that exemptions can be made for state guardrails that were installed negligently and whose design creates a dangerous situation.  This new ruling came after a case in which a person was in a car accident during winter.  The snowy and icy conditions caused the driver to spin out and hit a guardrail.  The guardrail ended up spearing the car and also caused injuries to the driver.  Although this exemption cannot be assumed in all car accident cases on our highways, it is an important ruling to keep in mind.
